Property Protection for LGBT Couples

   Over the last 25 years, our firm has devoted itself to creating family security for LGBT individuals as well as negotiating the multitude of issues that arise from dissolving a relationship which is outside the traditional legal structure. With a special emphasis on the emotional and practical needs of our clients, our attorneys provide alternative solutions for LGBT individuals as they begin their lives together and protection for when unfortunate circumstances require that relationships end.  Our services include:

Deed Preparation:  LGBT partners need to consider the best way to title their home when they make the decision to own property together. What should happen to the property upon the death of either partner? What are the tax considerations for owning the property jointly?  For one partner owning the property individually, while the other contributes to the mortgage payments?  How your names appear on the deed can significantly affect your future legal rights and obligations and should be considered carefully with a legal professional.

Property Agreements:  Buying a home together can be a very complex undertaking, particularly if there is a substantial difference between  you and your partner’s income. A Property Agreement can clarify who owns what percentage of the property, and what happens to it if an unexpected circumstance leaves ownership in dispute. A Property Agreement can also delineate each partner’s obligations regarding debts, including maintenance, taxes and improvements, and establish ownership of the personal property inside your home. 

Domestic Partnership Agreements:  A Domestic Partnership Agreement addresses issues such as your obligations regarding debts, income and personal belongings, even if you don’t own a home with your partner.  It also sets guidelines for your relationship and even ease property division after a break-up.
